Yenmo Partner Privacy Policy

(Applicable to Distributors, MFDs, and Wealth Managers using the Yenmo Partner Dashboard)

This Privacy Policy governs the collection, use, processing, storage, and disclosure of information by Yenmo Private Limited (“Yenmo”, “we”, “our”, “us”) in connection with the Partner Dashboard and related services provided to mutual fund distributors, wealth managers, and other authorized partners (“Partner”, “You”).

This Policy applies to:

  • Information relating to you as a Partner; and
  • Information relating to your customers (“Customers”) that is shared with or processed through the Yenmo platform.

By accessing or using the Partner Dashboard, you agree to the terms of this Privacy Policy.

For clarity:

  • You (the Partner) act as an independent intermediary and are responsible for obtaining lawful consent from your Customers before sharing their information with Yenmo.
  • Yenmo may act as:
    • An independent data fiduciary for certain processing activities; and/or
    • A data processor acting on behalf of lending partners (NBFCs / Banks).

Nothing in this Policy creates a joint data controller relationship unless expressly agreed in writing.

A. Partner Information

We may collect and process:

  • Full name, mobile number, email address
  • ARN number, registration details, business credentials
  • Company name, registered address, GST details (if applicable)
  • Bank account details for commission payouts
  • PAN and KYC documentation (where required)
  • Login credentials and authentication data
  • Dashboard usage data, reports accessed, cases processed
  • Communication records (calls, emails, WhatsApp, CRM logs, support tickets)

B. Customer Information Shared by You

When you onboard or process cases, we may collect:

  • Customer identity details (name, PAN, contact details)
  • KYC / VKYC information
  • Portfolio details (mutual funds, stocks, demat details)
  • Loan application details
  • Bank account details
  • Pledge instructions and depository-related information
  • Loan status, disbursal details, repayment history
  • Credit bureau information (where applicable and lawfully obtained)

You confirm that all such information is shared with valid consent and authorization.

A. Partner Data

We use Partner data to:

  • Onboard and verify your eligibility
  • Provide and manage access to the dashboard
  • Track case submissions and performance
  • Calculate and process commissions and incentives
  • Provide reports and analytics
  • Provide relationship management and support
  • Prevent fraud or misuse of the platform
  • Comply with legal and regulatory requirements

B. Customer Data

We use Customer data to:

  • Evaluate loan eligibility and portfolio acceptability
  • Share cases with lending partners (NBFCs / Banks)
  • Facilitate pledging of securities through depositories and intermediaries
  • Enable loan disbursal, servicing, and closure
  • Provide case updates to you
  • Comply with KYC, AML, regulatory, and audit requirements

We process Customer data strictly for legitimate business and compliance purposes.

Customer and Partner data may be shared on a need-to-know basis with:

  • Lending partners (NBFCs / Banks)
  • Depositories (NSDL / CDSL), RTAs, brokers, custodians
  • Payment service providers
  • Technology and infrastructure vendors
  • CRM, analytics, and support service providers
  • Regulatory bodies, law enforcement agencies, or courts as required by law

Yenmo does not sell Partner or Customer data to third parties.

By using the Yenmo platform, you represent and warrant that:

  • You have obtained explicit and valid consent from Customers before sharing their data.
  • You are authorized to act on behalf of your Customers.
  • The information shared is accurate and lawful.
  • You will not misuse platform data or access unauthorized accounts.
  • You will comply with applicable laws, including the Digital Personal Data Protection Act, 2023 and other financial regulations.
  • You will not reverse engineer, copy, scrape, or extract platform data beyond authorized usage.
  • You remain independently responsible for your advisory services and client relationships.

We implement reasonable administrative, technical, and physical safeguards, including:

  • Role-based access controls
  • Encryption where applicable
  • Secure hosting environments
  • Audit logs and monitoring
  • Restricted internal access to sensitive information

However, no digital system is completely secure. Yenmo shall not be liable for breaches caused by:

  • Partner negligence
  • Customer device compromise
  • Force majeure events
  • Third-party infrastructure failures beyond reasonable control

We retain data:

  • For the duration of the Partner relationship
  • For the lifecycle of any loan processed
  • As required under regulatory, tax, audit, and compliance obligations
  • For fraud prevention and dispute resolution purposes

Data may be retained even after account termination where legally required.

Subject to applicable laws, you may request:

  • Access to your Partner data
  • Correction of inaccurate data
  • Account deactivation
  • Deletion of data (subject to regulatory retention requirements)

Customer data rights requests must be handled in coordination with lending partners and in accordance with applicable law.

All information accessible through the Partner Dashboard, including:

  • Customer information
  • Commission structures
  • Loan eligibility rules
  • Internal documentation

shall be treated as confidential and must not be disclosed without prior written consent.

Yenmo shall not be liable for:

  • Actions taken by Partners beyond platform use
  • Misrepresentation made by Partners to Customers
  • Unauthorized sharing of login credentials
  • Regulatory non-compliance attributable to Partner conduct

We may update this Privacy Policy from time to time. Updates will be posted on the platform and/or communicated via email. Continued use of the dashboard constitutes acceptance of the revised policy.
